TO THE ABOVE NAMED DEFENDANT( S):

YOU ARE HEREBY SUMMONED to answer the Complaint in the above entitled action and to serve a copy of your Answer on the plaintiff’s attorney within twenty (20) days after the service of this Summons, exclusive of the day of service, or within thirty (30) days after completion of service where service is made in any other manner than by personal delivery within the State. The United States of America, if designated as a defendant in this action, may answer or appear within sixty (60) days of service hereof. In case of your failure to appear or answer, judgment will be taken against you by default for the relief demanded in the Complaint. In the event that there is a deficiency in the sale proceeds, a deficiency judgment may be entered against you.

NOTICE YOU ARE IN DANGER OF LOSING YOUR HOME.

If you do not respond to this summons and complaint by serving a copy of the answer on the attorney for the mortgage company who filed this foreclosure proceeding against you and filing the answer with court, a default judgment may be entered and you can lose your home.

Speak to an attorney or go to the court where your case is pending for further information on how to answer the summons and protect your property. Sending a payment to your mortgage company will not stop this foreclosure action.

YOU MUST RESPOND BY SERVING A COPY OF THE ANSWER ON THE ATTORNEY FOR THE PLAINTIFF (MORTGAGE COMPANY) AND FILING THE ANSWER WITH THE COURT.

This action is being amended to include ‘THE HEIRS AT LARGE OF RONNIE CARR A/K/A RONNIE L. CARR, DECEASED’, and ‘RONNIE CARR, JR., RHONDA CARR, JUSTEN L. CARR, and LEE ANN CARR, AS POSSIBLE HEIRS-AT-LAW TO THE ESTATE OF RONNIE CARR A/K/A RONNIE L. CARR, DECEASED.’ This action is also being amended in add ‘NEW YORK STATE DEPARTMENT OF TAXATION AND FINANCE’, and ‘UNITED STATES OF AMERICA’ as defendants to the action.

ERIE County is designated as the place of trial. The basis of venue is the location of the mortgaged premises.

NATURE AND OBJECT OF ACTION

The object of the above action is to foreclose a mortgage held by the Plaintiff recorded in the County of ERIE, State of New York on August 30, 2000, in Book 12894 of Mortgages, at page 58, said mortgage was then assigned by Mortgage Electronic Registration Systems, Inc., as nominee for Aegis Mortgage Corporation d/b/a UC Lending, a Corporation to the Plaintiff by virtue of an Assignment of Mortgage, recorded in the ERIE County Clerk’s Office on January 28, 2011, in Book 13522, at Page 4883.

TO THE DEFENDANT, except RONNIE CARR A/K/A RONNIE L. CARR, deceased, the plaintiff makes no personal claim against you in this action.

To the above named defendants: The foregoing summons is served upon you by publication pursuant to an order of the Hon. Kevin M. Dillon, a Justice of the Supreme Court of the State of N.Y., dated June 30, 2011 and filed along with the supporting papers in the Erie County Clerk’s Office. This is an action to foreclose a mortgage. Please take notice that the Village of Depew will be accepting sealed bids for the following sale of village property: vacant paper street (Harlan) between Burlington & Falcon.

All sealed bids must be submitted to the Clerk/Treasurer’s Office prior to the bid opening on August 11, 2011 at 11:01 am in the Council Chambers. Minimum bid is $5100.00 for the entire paper street or thirty five cents per square foot for any part of the street. The paper street is not a buildable parcel and will only be sold to adjacent property owners.

The property will be sold with the necessary easements for the Village and any other party that requests one, if deemed necessary. Any transaction costs, including but not limited to the cost of a search, survey, bidders attorney’s fees or recording costs, are the responsibility of the bidder.

Lancaster Industrial Development Agency will hold a public hearing on August 9, 2011, at 8:45 a.m. at the Lancaster Town Hall, 21

Central Avenue, Lancaster, New York, to consider the following proposed financial assistance requested of the Agency.

1. OLIVE TREE FAMILY RESTAURANT, INC. PROJECT - Request for Agency assistance in the form of a lease only or a lease with note and mortgage transaction and an installment sale transaction in a combined amount not to exceed $905,000.

Olive Tree Family Restaurant will be the occupant of the facility. Olive Tree Family

Restaurant, Inc. currently employs 35 full time and 5 part time employees and estimates that it will employ 45 full time and 5 part time employees within two years following the completion of the Project.
