PLEASE TAKE NOTICE that I, Maureen Jerackas, Administrator of the Village of Depew, County of Erie, State of New York, has duly received the Tax Roll and Warrant for the collection of taxes levied for the fiscal year June 1, 2017-through May 31, 2018.

The Village Clerk/Treasurer’s Office is located in the Municipal Building, 85 Manitou Street, Depew, New York 14043.

The office will be open to receive taxes from 8:30 a.m. to 4:15 p.m. Monday through Friday.

TAKE FURTHER NOTICE that taxes may be paid through July 3rd without penalty. The postmark determines the date of the payment. On all taxes received after such date, a penalty shall be added as follows:

July 4th to July 31st, 7.5 percent

August 1st to August 31st, 9.0 percent

September 1st to October 2nd, 10.5 percent

October 3rd to October 31st, 12.0 percent

November 1st: all unpaid taxes are returned to the County of Erie for collection

The office is closed July 4th, September 4th, and October 9th .

We are able to accept any payment amount.

If there is a balance owing after July 3rd the above penalty schedule will apply to the remaining balance only.

TAKE FURTHER NOTICE that all bills have been mailed to the owners of record. The purpose of this hearing is to consider the request from Benderson Development Company, LLC, petitioner and property owner of 3591 Walden Avenue, Lancaster, NY 14086. The petitioner is seeking relief from the following Village codes with respect to a proposed retail expansion of its property located at 3615 Walden Avenue: Section 350-32.A. Location of open off-street parking.

In any C or M-1 District, open off-street parking may occupy any required yard, except as otherwise provided for visibility and screening and except that it shall not be permitted within 10 feet of a street line or 10 feet of a lot in any R District; but when such parking is accessory to residential use, it shall be governed by the regulations pertaining to parking in R Districts in Subsection B of this section.

1.) Relief is requested for the front yard setback that does not meet the 10 feet requirement. (north property line)

2.) Relief is requested for the side yard setback that does not meet the 5 feet requirement. (west property line)

3.) Relief is requested for the rear yard setback that does not meet the 10 feet requirement. (south property line) Section 350-44. Required off-street parking, loading and stacking regulations.

4.) Relief is requested to allow only 52 parking spaces which does not meet the minimum requirement of 74 parking spaces for the proposed use of the property per the Village Code as determined by the Town of Lancaster Building Department. Section 148-4 Fences – Height limitations

No fence shall be more than six feet in height at the rear of homes or buildings situated in a residentially zoned district, which fence shall not extend forward of the rear building line of any existing or proposed building. No other fence or portions of a fence shall be higher than 36 inches (3 feet) in any front yard or 48 inches (4 feet) in any side yard.

5.) Relief is requested to allow a six feet (6’) high fence in a side yard which exceeds the four feet (4’) maximum height allowed by Village Code in a side yard.

Petitioner is seeking relief from the Village Code to allow a six foot (6’) high vinyl privacy fence in the side yard along the west property line for a length of five (5) lineal feet. The petitioner is also requesting permission for a five foot (5’) high arched gate across the driveway in the side yard for a length of ten (10) lineal feet. The proposed fence and gate exceed the four foot (4’) maximum height allowed by Village Code in a side yard. A variance is required to allow the proposed heights of the fence and gate that will be located in the side yard.

The purpose of this hearing is to consider the request from Ryan Braun and Hilda Braun, petitioner and property owner of 19 St. Mary’s Street, Lancaster, NY 14086. The petitioner is seeking relief from the following Village code with respect to the replacement of a porch in a front yard: Section 350-28. Front yard requirements.

In districts other than the Central Business District, minimum front yard requirements shall be as follows:

C. Front yard exceptions. A proposed building need not have a deeper front yard than the average of existing buildings within 150 feet of the proposed building on each side thereof. In the absence of an existing building on either side within such distance, there shall be deemed to be such building with a front yard depth of 25 feet. In an R District, such proposed building shall not have a front yard depth less than such average of such existing buildings; but nothing herein shall require a front yard depth of more than 50 feet. Also in an R District, front entrance enclosures may extend a maximum of five feet into the required front yard.

Petitioner is seeking relief from the Village Code to allow the completion of a two-story porch replacement project in a front yard. This project will result in an additional 3.8 feet encroachment into the front yard and the proposed porch will be located 4.24 feet from the front property line. A variance is required to allow the porch to be located in the front yard as currently proposed which does not meet the requirements as allowed per the Village Code.

SUMMARY OF

BOND RESOLUTION

The following is a summary of a bond resolution adopted by the Town Board of the Town of Lancaster on May 15, 2017. The proceeds from the sale of the obligations authorized in such bond resolution will be used for the purpose of financing the acquisition of accounting software for use by the Town, including all preliminary costs and necessary equipment, apparatus, warranties and other such costs incidental thereto and in connection with the financing thereof (collectively, the “Purpose”), at an estimated maximum amount of $175,000. Such bond resolution authorizes the issuance and sale of a serial bond or bonds and a bond anticipation note or notes in anticipation of the issuance and sale of such serial bonds, in an aggregate principal amount not to exceed $175,000 such amount to be offset by any federal, state, county and/or local funds received. The period of probable usefulness for such purpose is five years. Sealed bids for the proposed improvements at the Keysa Park for Town Pool Renovation will be received by the Town Clerk at her office in the Town Hall, 21 Central Avenue, Lancaster, New York, on or before 10:00 A.M. local time on June 8, 2017, at which time they will be publicly opened and read aloud.

Contract Documents may be examined at the office of the Town Clerk and at the office of the ENGINEER, Wm. Schutt & Associates, P.C., 37 Central Avenue, Lancaster, New York 14086 between the hours of 9:00 A.M. and 4:00 P.M., except Saturdays, Sundays and Holidays.

Contract Documents may be obtained at the office of the ENGINEER upon deposit of $50.00 per set [two (2) checks of $25.00 each payable to the ENGINEER]. Each proposal must be accompanied by the deposit of a certified check, payable to the Town of Lancaster, for a sum equal to five percentum (5%) of the total amount of the Bid, or a bond with sufficient sureties in a penal sum equal to five percentum (5%) of such total bid amount, conditioned that if the proposal is accepted, that he will execute within fifteen (15) days from the date of the acceptance of the proposal, a suitable security bond in the amount of the Contract, conditioned for the faithful and prompt performance and completion of the Work specified in the Contract.

All bid deposits except that of the successful bidder will be returned.

Upon acceptance of his Bid, if the successful bidder fails to enter into a Contract pursuant to the requirements of the Contract Documents, or fails to give the further security prescribed in this Notice, with the same time limited therein, then the check deposited as aforesaid and the monies standing to the credit of the same, shall be forfeited to the Town as liquidated damages, or the payment of the bond enforced for the benefit of the Town.
