PLEASE TAKE NOTICE that the Board of Trustees passed a resolution at their September 25, 2017 Village Board meeting to conduct a public hearing in the Council Chambers of the Lancaster Municipal Building, 5423 Broadway, Lancaster, New York, on Monday, October 23, 2017, at 7:15 p.m. regarding the use of Federal Community Development Funds in the Village of Lancaster.

The Village of Lancaster is eligible for a Federal Community Development grant under Title I of the Housing and Community Development Act of 1974, as amended.

The purpose of this hearing is to provide an opportunity for citizens to express community development and housing needs and to discuss possible projects which would benefit low and moderate income persons in the Village of Lancaster.

Citizens are urged to attend this meeting to make known their views and/or written proposals on the Village of Lancaster’s selection of potential projects to be submitted for possible funding by the Federal Community Development Grant Program

The hearing will also present a review of prior Community Development projects and expenditures and a discussion of eligible activities. The meeting room is wheelchair accessible. Please take notice that the Zoning Board of Appeals of the Village of Lancaster, New York, will hold a public hearing in the Council Chambers of the Municipal Building at 5423 Broadway, Lancaster, New York, on Thursday, October 19, 2017, at 6:00 p.m.

The purpose of this hearing is to consider the request from Robert Helwig, petitioner and property owner of 3 Liberty Avenue, Lancaster, NY 14086. The petitioner is seeking relief from the following Village codes with respect to the installation of a privacy fence in a front and side yard on a corner lot: Section 148-4 Fences – Height limitations.

No fence shall be more than six feet in height at the rear of homes or buildings situated in a residentially zoned district, which fence shall not extend forward of the rear building line of any existing or proposed building. No other fence or portions of a fence shall be higher than 36 inches (3 feet) in any front yard or 48 inches (4 feet) in any side yard. Section 148-5 Fences – Location.

Any fence erected in a front yard shall be placed at least two feet back from the sidewalk. Section 148-6 Fences – Obstructions affecting public safety.

Any fence, wall or similar structure, as well as shrubbery, which unduly cuts off light or air, which may cause a nuisance, a fire hazard or a dangerous condition or an obstruction to combating fires or an obstruction to men and equipment for combating fires, which may affect public safety, is hereby expressly prohibited. Further, no fence shall be erected in a front yard in a residential district or along a public right-of-way unless the fence is uniformly less than 50% solid.

Petitioner is seeking relief from the Village Code to allow the installation of a six foot (6’) high vinyl fence in a front and side yard on a corner lot. A corner lot is considered to have a front yard along each street. The six foot (6’) high fence exceeds the three foot (3’) maximum height allowed in a front yard and the four foot (4’) maximum height allowed in a side yard per the Village Code. The proposed fence located in the front yard area is also less than two feet from the sidewalk and more than 50% solid which is not allowed per the Village Code.

The item for consideration by the Zoning Board of Appeals at this meeting is:

1. The petition of William Slachciak and Valerie Hurst, 193 Westwood Road, Lancaster, New York 14086 for one [1] variance for the purpose of constructing a pole barn on premises owned by the petitioners at 193 Westwood Road, Lancaster, New York, to wit:

A variance from the requirements of Chapter 50, Zoning, Section 9D.(4) of the Code of the Town of Lancaster. The area of the proposed accessory structure is 1,200 square feet.

Chapter 50, Zoning, Section 9D.(4) of the Code of the Town of Lancaster limits the area of an accessory structure to 750 square feet. The petitioners, therefore, request a 450 square foot accessory use area variance.

Chapter 50, Zoning, Section 10C.(2)(a) of the Code of the Town of Lancaster requires a seventy five [75] foot lot width at the street line. The petitioner, therefore, request a five [5] foot lot width variance.

3. The petition of Christopher Vega, 5745 Broadway, Lancaster, New York 14086 for one [1] variance for the purpose of constructing master bedroom addition on the premises owned by the petitioner at 5745 Broadway, Lancaster, New York, to wit:

A variance from the requirements of Chapter 50, Zoning, Section 10D.(1)(a) of the Code of the Town of Lancaster to permit construction of an addition at the rear of the house within eight [8] feet from an existing principal structure.

Chapter 50, Zoning, Section 10D.(1)(a) of the Code of the Town of Lancaster requires an accessory structure to be located ten [10] feet from any other structure. The petitioner, therefore, requests a two [2] foot variance.

4. The petition of Gary J. and Suzanne M. Blank, 16 Shadyside Lane, Lancaster, New York 14086 for one [1] variance for the purpose of constructing a storage shed on premises owned by the petitioners at 16 Shadyside Lane, Lancaster, New York, to wit:

A variance from the requirements of Chapter 50, Zoning, Section 10D.(1)(b) of the Code of the Town of Lancaster. The storage shed will be positioned three [3] feet from the side yard lot line.

Chapter 50, Zoning, Section 10D.(1)(b) of the Code of the Town of Lancaster requires a five [5] foot side yard lot line set back for an accessory structure. The petitioners, therefore, request a two [2] foot side yard lot line set back variance.

Chapter 50, Zoning, Section 30F.(2)(c)[3][e] of the Code of the Town of Lancaster limits the total maximum face area of a pole sign on the premises to sixty-four [64] square feet. The petitioner, therefore, requests a forty nine [49] square foot variance of the total maximum face area permitted for this proposed pole sign.

6.
