NOTICE IS HEREBY GIVEN that the annual meeting and election of the LANCASTER CENTRAL SCHOOL DISTRICT, Erie County, New York, will be held on TUESDAY, MAY 15, 2012 from 7:00am prevailing time to 9:00pm prevailing time in the LANCASTER CENTRAL HIGH SCHOOL, located at One Forton Drive, Lancaster, New York, for the purposes of voting on the budget for the 2012-13 fiscal year, voting on a proposition undertaking a district-wide capital improvement program, establishing a school bus reserve fund and transferring remaining balance on deposit in existing School Bus Reserve Fund, the acquisition and expenditure of funds from an existing School Bus Reserve Fund to purchase school buses, and for electing two at large members of the Board of Education, who will each serve a three (3) year term.

TAKE FURTHER NOTICE that all candidates for the office of member of the Board of Education shall be nominated by petition. Each petition shall be directed to the Clerk of the District, shall be signed by at least sixty-five (65) qualified voters of the District, shall state the residence of each signer and shall state the name and residence of the candidate. Each petition must be filed in the office of the Clerk of the District between the hours of 9:00am and 5:00pm, not later than the thirtieth day preceding the annual meeting and election, to wit, April 16, 2012.

TAKE FURTHER NOTICE the candidates for the Board of Education receiving the two highest vote totals will each be elected to a three-year term, commencing July 1, 2012. Vacancies shall not be considered separate, specific offices, and the nominating petitions therefore shall not describe any specific vacancy upon said Board of Education for which the candidate is nominated.

TAKE FURTHER NOTICE that the voting on the budget and other propositions will consist of voting on the following propositions, as well as other such matters as may be lawfully presented at the meeting: PROPOSITION NO. 1

Shall the following resolution be adopted, to wit:

RESOLVED, that the budget for the Lancaster Central School District, Erie County, New York, for the fiscal year commencing July 1, 2012 and ending June 30, 2013, as presented by the Board of Education, is hereby approved and adopted and the required funds therefore are hereby appropriated and the necessary real property taxes required shall be raised by a tax on the taxable property in said District to be levied and collected as required by law. PROPOSITION NO. 2

RESOLVED, that the Board of Education of the Lancaster Central School District is hereby authorized to undertake a district wide capital improvement program consisting of alterations, renovations and improvements to all existing buildings and facilities of said District, including in each case, health and safety related items, site improvements for various school purposes and other appurtenant and related improvements, and the acquisition and installation in and around the foregoing improvements of original furnishings, equipment, machinery, apparatus, and other services incidental thereto, all at a total estimated total cost not to exceed $19,500,000, with such cost being raised by a tax upon the taxable property of said District to be levied and collected in annual installments in the years and in the amounts as the Board of Education shall determine, with such tax to be partially offset by State aid available therefore, and in anticipation of such tax, by obligations of said District as may be necessary. PROPOSITION NO. 3

RESOLVED, that the Board of Education of the Lancaster Central School District is hereby authorized to expend $1,157,470 from the District's existing School Bus Reserve Fund to purchase seven 65-passenger school buses at an estimated maximum cost per bus of $107,896 and six 29-passenger school buses at an estimated maximum cost per bus of $67,033. PROPOSITION NO. 4

RESOLVED, that the Board of Education of the Lancaster Central School District is hereby authorized and directed to:

(A) establish a capital reserve fund pursuant to Education Law Section 3651, to be known as the “School Bus Reserve Fund,” for the purpose of financing, in whole or in part, the purchase of school buses and vehicles by the School District, with the ultimate amount of such reserve fund not exceeding nine million dollars ($9,000,000) plus any accrued earnings on amounts deposited in such reserve fund, the probable existence of said reserve fund being ten (10) years, but with such reserve fund continuing in existence for its stated purpose until liquidated in accordance with the Education Law, and the sources from which funds shall be obtained for said reserve fund being (1) current and future unappropriated fund balances from the General Fund of the District, as directed by the Board of Education, and (2) any other appropriations authorized by the voters from time to time; and

(B) transfer to said capital reserve fund the entire balance on deposit in said District’s existing School Bus Reserve Fund established pursuant to Education Law Section 3651 pursuant to a proposition approved by the qualified voters of said District on May 15, 2007.

TAKE FURTHER NOTICE that the Board of Education will hold a public hearing to present the budget of the necessary funds to meet the estimated expenditures for the ensuing 2012-2013 school year for school purposes on May 7, 2012 at 7:00pm prevailing time in the Lancaster High School Auditorium.

TAKE FURTHER NOTICE that voting machines will be used to record the vote on the budget, on all other propositions, and on the election of members of the Board of Education.

TAKE FURTHER NOTICE that the Board of Education of this District has adopted rules for the use of voting machines and the submission of questions or propositions to be placed thereon, and printed copies for general distribution in the District are available at the office of the District Clerk located in the District Office, 177 Central Avenue, Lancaster, New York.

TAKE FURTHER NOTICE that the Board of Education of this District will have prepared and completed a detailed statement in writing of the amount of money which will be required for the ensuing 2012-2013 school year for school purposes, specifying the several purposes and the amount for each. The amount for each purpose estimated necessary for payments to Boards of Cooperative Educational Services shall be shown in full, with no deduction of estimated state aid. The amount of state aid provided and its percentage relationship to the total expenditures shall also be shown. Such statement shall be completed at least seven (7) days before the budget hearing at which it is to be presented and copies thereof shall be prepared and made available on the District’s website, or upon request, to residents within the District during the period of seven (7) days before the budget hearing and/or fourteen (14) days immediately preceding the annual meeting and election, and may be obtained by any resident in the District at each school in the District in which school is maintained during the hours of 8:00am to 4:00pm prevailing time during the fourteen (14) days immediately preceding the annual meeting and election, and in the District Office.

TAKE FURTHER NOTICE that applications for absentee ballots will be obtainable during school business hours at the office of the District Clerk. Completed applications must be received by the office of the District Clerk at least seven (7) days before the District Vote if the ballot is to be mailed to the voter, or on the day before the election, if the ballot is to be issued to the voter in person. Absentee ballots must be received by the office of the District Clerk not later than 5:00pm prevailing time on the day of the District Vote. Shall the following resolution be adopted, to wit:

RESOLVED, that the Board of Education of the Depew Union Free School District (“District”) shall be authorized to expend a total of $380,338 from the District’s Vehicle Purchase Reserve Fund to purchase three 66-passenger school buses and one 28 passenger school bus with three wheel capacity to be used in the transportation program of the District, which is the cumulative net cost for the purchase of the four school buses after application of a $15,100 allowance for the trade-in of seven existing school buses.

TAKE FURTHER NOTICE that voting machines will be used to record the vote on the budget proposition, the vehicle purchase reserve fund proposition, and the election of two members to serve on the Board of Education.

RESOLVED, that the Board of Education of the Depew Union Free School District (“District”) shall be authorized to expend a total of $380,338 from the District’s Vehicle Purchase Reserve Fund to purchase three 66-passenger school buses and one 28 passenger school bus with three wheel capacity to be used in the transportation program of the District, which is the cumulative net cost for the purchase of the four school buses after application of a $15,100 allowance for the trade-in of seven existing school buses.

TAKE FURTHER NOTICE that voting machines will be used to record the vote on the budget proposition, the vehicle purchase reserve fund proposition, and the election of two members to serve on the Board of Education.

TAKE FURTHER NOTICE that the Board of Education of this District has adopted Rules for the Use of Voting Machines and the Submission of Questions or Propositions to be placed thereon, and printed copies for general distribution in the District are available at the office of the District Clerk located in the District offices, 591 Terrace Boulevard, Depew, New York.

TAKE FURTHER NOTICE that applications for absentee ballots can be obtained Monday through Friday, except holidays, between the hours of 9:00 A.M. and 4:00 P.M. at the office of the District Clerk. Completed applications must be received by the office of the District Clerk or her designee at least seven (7) days before the annual meeting and election if the ballot is to be mailed to the voter or by the day before the election if the ballot is to be issued to the voter in person. Absentee ballots must be received by the office of the District Clerk not later than 4:00 PM on May 15, 2012.

TAKE FURTHER NOTICE that a list of persons to whom absentee ballots are issued will be available for inspection by any qualified voter of the District in the office of the District Clerk between the hours of 9:00 AM and 4:00 PM, on the five days prior to the day of the election, except Sundays, and such list will also be posted at the polling place on the day of the annual meeting and election. Any qualified voter may, upon examination of such list, file a written challenge of the qualifications as a voter of any person whose name appears on such list, stating the reasons for such challenge. Such written challenge shall be transmitted by the clerk to the Chief Election Inspector on May 15, 2012.
