NOTICE IS HEREBY GIVEN that a bond resolution, a summary of which is published herewith, has been adopted by the Town Board of the Town of Lancaster, County of Erie (the “Town”), on May 2, 2016 and the validity of the obligations authorized by such resolution may be hereafter contested only if:

1. (a) such obligations were authorized for an object or purpose for which the Town is not authorized to expend money, or

(b) the provisions of the law which should be complied with as of the date of publication of this notice were not substantially complied with and an action, suit or proceeding contesting such validity is commenced within 20 days after the date of such publication of this notice, or

2. such obligations were authorized in violation of the provisions of the Constitution of New York.

SUMMARY OF

BOND RESOLUTION

The following is a summary of a bond resolution adopted by the Town Board of the Town of Lancaster on May 2, 2016. The proceeds from the sale of the obligations authorized in such bond resolution shall be used for the specific purpose of the acquisition of a maintenance vehicle and equipment for the Town’s Highway Department, including all necessary equipment, apparatus and warranties and all preliminary costs and costs incidental thereto and in connection with the financing thereof (collectively, the “Purpose”). The estimated maximum cost of the Purpose is $400,000. Such bond resolution authorizes the issuance and sale of a serial bond or bonds and a bond anticipation note or notes in anticipation of the issuance and sale of such serial bonds, in an aggregate amount not to exceed $400,000, said amount to be offset by any federal, state, county and/or local funds received. Such bond resolution was adopted subject to permissive referendum, and such permissive referendum period has elapsed without the filing of a petition. The period of probable usefulness for such purpose is 15 years. A copy of the resolution summarized herein is available for public inspection during normal business hours at the Office of the Town Clerk, located in the Town Hall, 21 Central Avenue, Lancaster, New York.

The bids will be at that date, time, and place, publicly opened and read aloud. All work shall be done in accordance with drawings and specifications prepared by Young + Wright Architectural, 740 Seneca Street Buffalo, NY 14210. All bidders shall be expected to keep bid prices firm for 45 days from date of bid opening, during which time the Owner will be able to make awards therein.

Plans and specifications are available to contractors on Tuesday, May 31, 2016 at 3:00 pm by contacting Avalon Document Services at (716) 995-7777 or visiting their online plan room at www.avalonplanroom.com. A deposit of $100.00 per set will be required & shall be made out to the Lancaster Central School District. A pre-bid conference will be held to discuss the scope of the project, tour the site, and answer bidder questions on Tuesday, June 7, 2016 at 4:00 pm. The meeting shall start in the lobby at Hillview Elementary School, 11 Pleasantview Drive, Lancaster, NY 14086.

The deposit will be refunded to all Prime Contractor Bidders returning the drawings and specifications in good, unmarked condition within ten (10) working days after the bid opening. Prime contractors who are non-bidders returning complete sets in good, unmarked condition with the above time limit will be refunded also. No part of the deposit will be refunded for partial and/or damaged sets of the drawings and specifications.

The bids will be made as specified by the architect in the Information for Bidders and will include a certified check or a Bid Bond in an amount of not less than 5% of the Base Bid. The Bid Bond will state that the Bidder will enter into the Contract if awarded by the Owner and execute further security for the faithful performance of the Contract as required by the Owner. Bidders will note the required conditions of employment and the minimum New York State Labor Department prevailing wage rates to be paid under the contract. The Board of Education reserves the right to reject any or all bids and to advertise anew, and to award a contract for the whole or such portion of the work as it determines to be in the best interest of the District.
