TWO PUBLIC HEARINGS

TO BE HELD MARCH 12th, 2018 PLEASE TAKE NOTICE;

That the Village of Lancaster Board of Trustees will conduct two public hearings in the Council Chambers of the Lancaster Municipal Building, 5423 Broadway, Lancaster, New York on Monday, March 12th, 2018 beginning at 7:15 P.M. to consider the following local laws in the following order:

PUBLIC HEARING 1) To consider a local law amending Chapter 325 “Vehicle and Traffic” of the Village Code of the Village of Lancaster, New York to provide for parking enforcement by the Village Code Enforcement Officer and Assistant to the Village Code Enforcement Officer. “Article X” would be added to provide as follows:

Article X “Authority of the Code Enforcement Officer and Assistant to the Code Enforcement Officer to Enforce Parking Laws and Regulations within the Village of Lancaster.”

Section 325-76. Pursuant to Section 10(4)(a) of the Municipal Home Rule Law, the Code Enforcement Officer of the Village of Lancaster and Assistant to the Code Enforcement Officer of the Village of Lancaster are hereby authorized to issue and serve appearance tickets for violations of New York State and Lancaster of Village parking laws and regulations within the Village of Lancaster.

Section 325-77. Each appearance ticket issued pursuant to this Article shall indicate the date of issuance of the appearance ticket, the title and name of the issuing person, the date, hour and location of the violation and the license plate number of the vehicle. The appearance ticket shall also indicate the specific section of the Village Code or New York State Vehicle and Traffic Law of the violation charged and direct the owner or operator to within 30 days pay to the Court Clerk at the Village of Lancaster Traffic Violations Bureau the fine established by Section 325-48 of this Chapter or apply to the Court Clerk at the Village of Lancaster Traffic Violations Bureau for a trial before the Village Justice, the date and time of which to be set by the Court Clerk.

PUBLIC HEARING 2) To consider a local law amending Chapter 14 “Ethics” to permit the personal use of the Fire Chief and Assistant Fire Chiefs vehicles pursuant to the Fire Chief and Assistant Fire Chiefs vehicle use policy established by the Village Board.

AND RESTATEMENT OF

BOND RESOLUTION

VILLAGE OF DEPEW

NOTICE IS HEREBY GIVEN that a resolution amending and restating a prior bond resolution, a summary of which is published herewith, has been adopted by the Village Board of Trustees of the Village of Depew, in the County of Erie, New York, on February 26, 2018, and the validity of the obligations authorized by such resolution may be hereafter contested only if:

1. (a) such obligations were authorized for an object or purpose for which the Village is not authorized to expend money, or

(b) the provisions of law which have been complied with as of the date of publication of this notice were not substantially complied with and an action, suit or proceeding contesting such validity is commenced within 20 days after the date of such publication of this notice, or

2. such obligations were authorized in violation of the provisions of the Constitution of New York.

SUMMARY OF RESOLUTION

AMENDING AND RESTATING A

PRIOR BOND RESOLUTION

The following is a summary of an amending bond resolution, adopted by the Village Board of Trustees of the Village of Depew on February 26, 2018, that amends and restates a bond resolution that was previously adopted by the Village Board of Trustees on February 27, 2017 (the “Original Bond Resolution”). The proceeds from the sale of the obligations authorized under the bond resolution (as amended and restated) shall be used for a sewer system capital improvements project being undertaken in response to a New York State Department of Environmental Conservation Order on Consent, such project to generally include, but not be limited to, the installation of a cured-in-place pipe (“CIPP”) lining system for approximately 17,649 linear feet of sanitary sewer pipe, point repairs to sanitary and storm sewer pipes, manhole rehabilitations, and various restoration work, as well as other improvements more fully identified in (or contemplated by) such engineering project plans prepared by GHD, and including all preliminary work and necessary equipment, materials, and site work and all preliminary costs and costs incidental thereto and in connection with the financing thereof (collectively, the “Project”), at an estimated maximum amount of $1,700,000. Such amending and restating bond resolution modifies the scope of the project to include additional improvements, as well as any other associated work. The period of probable usefulness for such purpose is 40 years. A copy of the resolution amending and restating the prior bond resolution, as summarized herein, is available for public inspection during normal business hours at the Office of the Village Clerk, located in the Village Hall, 85 Manitou Street, Depew, New York.
